Individuals' Rights and Responsibilities
Individual's Rights
The rights of individuals are the same as all citizens. Every individual, unless legally determined otherwise, shall be considered capable of exercising his full range of constitutional statutory and civil rights. Federal Public Law 95- 602 and IC 16-14-1.g., Public Law 155 guarantee individual’s specific rights as mandated. These include:
- The right to mental health services or developmental training in accordance with standards of professional practice appropriate to needs in the least restrictive environment and designed to afford a reasonable opportunity to improve existing conditions.
- The right to humane care and protection from harm.
- The right to practice the religion of one's choice.
- The right to contact and consult with legal counsel and private practitioners of one’s choice at one’s own expense.
- The right to be free of restraint except when necessary to prevent danger or injury to himself or others.
- The right to be informed of the nature of the treatment or habilitation plan proposed.
Additionally, the following rights have particular bearing upon individuals being provided support:
1. The Right to Privacy
- Everyone has the need to be alone at times. The individual's right shall be respected when toileting, sleeping, having phone conversations with family or friends, or simply in the mood.
- Supported living homes are private residences and are to be respected as such.
- No research projects shall be conducted involving individuals or within their residences without written consent from all appropriate parties.
- The use and confidentiality of individual's case records are protected by public law and Federal and State guidelines and Globe Star shall operate under these guidelines.
2. The Right to Property
- All individuals have the right to keep personal possessions. Individuals unable to assume this responsibility shall be assisted and trained to handle personal possessions.
3. The Right to Community Integration
- In order to provide the opportunity for social integration participation in the community's activities is encouraged and shall be provided.
- Globe Star shall provide individuals with opportunities to develop social, religious, educational and recreational skills.
4. The Right to Free, Uncensored Communication
- Help with reading or writing letters, or other forms of communication will be provided to all individuals.
5. The Right to Individuality
- Each individual is to be treated with consideration and respect and with full recognition of his dignity and individuality. Individuals shall not be regimented or managed as a group.
- Each individual is entitled to practice the religion and beliefs of his choice. Services are non-sectarian and individuals shall be considered for placement without discrimination based on race, creed, or religious beliefs.
6. The Right to Dignity
- No individual shall be used as a human subject in research. Any research conducted by Globe Star shall operate under and comply with government standards.
- A recipient of services has the right to appeal a decision or service, which has been denied to him. He may contact his case manager, school social worker, or other member of the support team for further information regarding this appeal process.
- Any right that is restricted shall be based on a decision made by the IDT team.
Individual’s Responsibilities
Individuals receiving services at Globe Star are encouraged and assisted in recognizing and exercising their rights as consumers of service and citizens as well as honoring their responsibilities. Your rights and responsibilities can be listed to include:
- You can expect to be treated with consideration, respect and as an individual with dignity.
- You are entitled to protection from unreasonable risk.
- You can expect your services to have a reasonable chance to improve your life.
- We will help you to get legal counsel at your expense.
- You will not be forced to participate in religious or political activities.
- You can expect your life to remain private and that your information will not be shared with individuals not involved in your program without your permission.
- You will receive services without regard to your race, color, creed, national origin, age, sex, disability, political affiliation or religious belief.
- If you have a problem while at Globe Star, you must first try to solve it using the grievance procedure. If this fails, we will help you contact protective rights agencies.
- You may look at and copy your records (at your expense).
- We will provide, or provide access to, local, state, and federal laws and regulations.
- You can expect to be protected from physical, mental, and sexual abuse.
- You have the right and responsibility to help make your Individual Program Plan.
- You have the obligation to follow the rules of your service area.
- You have the right to refuse treatment and to be informed of the possible results of refusing treatment.
- You have the right to be fairly paid.
- You have the obligation to carry out your responsibilities as you agreed in your program plan.
- You have the obligation to respect the rights of others.
